Marines Win Reversal
Nearly three years afterr their arrest and conviction on charges of disloyalty, under the Smith Act of 1950, two black marines had their sentences reversed by the Court of Military Appeals.
Pvt William Harvey Jr. sentenced originally to six years for statements with intent to promote disloyalty, and George Daniels sentenced to ten years for telling other black Marines that they should not fight in a white man's war. Daniels was originally convicted on eight counts of violation of the Smith act.
At the same time, on July 10, the three man Military Court of Appeals ruled thaat the two men were guilty of the lesser offenses of solicitation to insubordination and refusal of duty.
